Terms & Conditions of Sale
The transport of persons subject to the payment is regulated by decrees published in the Official Journal (Gazette) of the French Republic.
The vehicles which are hiring are driven by the qualified drivers holding the respective license of capability and having the necessary qualification. Vehicles and authorized personnel are controlled by the Préfecture des Bouches du Rhône (13) and Atout France to ensure this service.
Subject to all legal provisions, any dispute arising is, by express agreement, the exclusive jurisdiction of the Tribunal de Commerce de Marseille (Bouches du Rhône), or any other jurisdiction is only by the choice of the company SAS Provence Amazing Tour.
General conditions of sale as on 1st January 2020:
Any reservation request made by the company Provence Amazing Tour involves the acceptance of these General terms.
The prices indicated are calculated inclusive of all taxes (including VAT) in Euros (€).
Our prices include the VAT at the current rate in force:
– For transfer operations, the VAT applicable on the date of 1st January, 2020 is 10%.
– For excursions, the VAT applicable on the date of 1st January, 2020 is 20%.
– For events, the VAT applicable on the date of 1st January, 2020 is 20%.
Our prices do not include the parking fees, fees for the communications made between the driver’s vehicle phone (0.50 Euros per minute local call), entrance fees to the sites (museums, theatres, castles…), fees for the driver meals (fixed price 20.00 Euros per meal), fees for the accommodation of driver during travelling (fixed price 1 night and breakfast: 110.00 Euros) or abroad (fixed price 1 night and breakfast: 130.00 Euros).
For all services, except for transfers, including the time slot between 11:30 and 14:00 or the time slot between 19:00 and 21:00 a driver meal with 20.00 Euros (not-subjected to VAT) will be charged extra.
Time and Kilometre are counted from start-and-return point of garage (F 13015 MARSEILLES). Any exceeding time and/or kilometres not included in the initial quote will be added to the final invoice. Any started hour due.
Conditions of the exercise of activities (special event management):
On simple request of Provence Amazing Tour, the customer agrees himself to providing a medical certificate authorizing each participant to practise the ordered sports activities.
The company can refuse to leave one or more participants take part in the activity if this certificate is not provided by the customer. In this case, no refund will be required.
The customer is informed that the course of activities could undergo any possible changes either of an independent event or events beyond the control of Provence Amazing Tour, or of decisions coming from the concerned competent authorities. Under these conditions, the company Provence Amazing Tour will in no case be liable for any amendment or cancellation.
The cancellation emanating from the Customer involves the payment of variable expenses according to the following methods:
– More than 45 days before the departure: 10% of the amount of travel (trip) fee,
– From 45 to 21 days before the departure: 25% of the trip amount,
– From 20 to 8 days before the departure: 50% of the trip amount,
– Less than 7 days of departure or no show: 100% of total trip.
– Failure at departure (no show), for any reason whatsoever, is considered as a cancellation on behalf of the Customer.
It will be the same in the case of non submission of administrative documents (identity card, passport, visa …) or medical required.
The subscribed optional insurance are not refundable whatever the date and the cause of cancellation.
• Any modification or cancellation by the customer intervening more than 45 days prior to departure will result in 20% of charges from the total travel amount.
• From 45 days to 8 days of the departure the cancellation fees represent 75% of the total travel amount.
• From 7 days, 100% charge unless.
Down payments (instalments) are not restorable. Any cancellation of a reservation by the customer, whatever the cause, it involves to the loss of the deposit in reference to the title of liquidated damages and irreducible.
All our services are payable in cash before the mission except for customers-companies having an account open in our establishment and for which a periodic invoicing is generated.
In all the cases, the sponsor of the requested service is only responsible for his payment in the case of failure of the user, including in the cases of preliminary or later request of moved invoices. Our services are payable in cash with receipt of invoices for the customer-companies benefiting from us with an open account in our books, except for the particular contractual agreements which will have been confirmed in writing. No discount is given for the payment to a former date. In the case of delay of payment, late penalties will be applied without any reminder being necessary. They run automatically upon the day following the date of settlement covered the invoice or, failing this, the thirty-first day following the date of the performance of the service. The rate of the applicable penalties is fixed to (2) twice the legal rate of interest.
For long-term services and customers in account, the settlement of invoices (bills) can be a weekly or periodically payment. In case of late payment, our company has the right to suspend or cancel the service orders being without prejudice to any other remedy.
For weddings or tour packages, reservation becomes determined after payment of a non-refundable deposit equal to 30% of the amount of the service, the balance (less deposit) must reach us 07 days prior to the beginning of service.
We accept payment by:
– Visa, Eurocard MasterCard, American Express.
Our prices are subject to change without notice. The kilometres and time are counted from start-and-return point of garage.
The prices indicated on our quotes are valid for fifteen (15) days.
The volume of luggage transported is proportional to the capacity of the vehicle. The luggages are accepted within a maximum transported limit of 20 kg per person and remain in the custody thereof. We are not responsible for the objects forgotten in our vehicles or elsewhere during the delivery service.
Pets are not allowed in vehicles, except in a cage or bag for this purpose, provided by the customer.
Insurance and liability:
The company Provence Amazing Tour is totally liable towards the purchaser of the good organization for the obligations resulting from the contract. However, it may be exempt from all or part of its liability by proving that the failure or improper performance of the contract is ascribable either to the purchaser or with the fact, unforeseeable and unavoidable, of a foreign national to the supply of the services envisaged with the contract, or a case of force majeure.
The customer can subscribe to a personal accident insurance or a cancellation, additional insurance at least 30 days before the date planned for the completion of the activity.

Respect the equipment is mandatory, any damage will be charged to the customer.
The driver or the service provider has all the rights to suspend the service in the event of unjustifiable overflow.
The driver must respect the highway rules.
Any claims must be settled within eight days after the service by registered mail with acknowledgement of receipt.
After the end of this period, they will not be considered. In the case of dispute, the Tribunal de Commerce de Marseille (Bouches du Rhône) is the only competent jurisdiction.
